Game Locker Seller Terms

These Seller Terms apply if you are a Seller (see the Game Locker Marketplace Terms), together with the Game Locker Marketplace Terms.

The sale contract between you and the Buyer are in the Conditions of Sale.

If there’s any inconsistency between these Seller Terms and the Game Locker Marketplace Terms, these Seller Terms apply to your selling activity.

1. Becoming a seller

1.1 Account required. You must hold a Game Locker account to sell on the Marketplace and be based in Australia.

1.2 Verification. Game Locker may require you to complete a verification process to register or remain as a Seller. We may decline, suspend or withdraw your selling privileges if verification fails or information is inaccurate or out-of-date, and may require re-verification at any time. This is to protect all Marketplace users. Proceeds won’t be remitted and listings won’t be visible until verification is complete.

1.3 Individuals. If you are an individual, verification may include identity checks which we may conduct via a third-party provider.

1.4 Code of Conduct. You must comply with the Seller Code of Conduct in connection with all listings and sales in the Marketplace. You must not invite, encourage or require a Buyer within the Marketplace to complete a sale outside the Marketplace.

1.5 Returns policy. In order to sell on the Marketplace you must have in place a Seller returns policy that complies with the requirements of the Game Locker Marketplace Terms (including the Shipping, Returns & Refunds Information) and upload it to the Marketplace (Seller Returns Policy).

2. Listings and Items

2.1 Listing accuracy. You must ensure your listings on the Marketplace are accurate and complete (including an Item’s condition, set, printing and language), and comply with applicable laws, third-party rights and the Game Locker Marketplace Terms in listing any items for sale (Items).

2.2 Item eligibility. You must only list Items you own or are otherwise legally authorised to sell. You warrant that all Items you list for sale are authentic, legally permitted for sale, and don’t infringe a third party’s rights.

2.3 Prohibited Items. You must not list or sell any Items of the kind listed below or which are prohibited by the Acceptable Use Policy:

  • (a) Items other than trading cards located in Australia;
  • (b) a counterfeit, replica, reproduction, custom-made or "proxy" card or Item;
  • (c) an Item that has been damaged, altered, doctored, resurfaced, recoloured, trimmed, re-backed or otherwise physically modified in a way that is not clearly and prominently disclosed in the listing;
  • (d) an Item bearing a third-party grading, authentication or certification mark (e.g. PSA, BGS, CGC, SGC) or slab that is fake, fraudulent, tampered with, or not genuinely issued by the stated grading company;
  • (e) a stolen Item, or an Item you do not own or are not authorised to sell;
  • (f) an Item that is not in your possession or control;
  • (g) an Item that infringes, or that Game Locker reasonably believes may infringe, a third party's intellectual property or other rights;
  • (h) an Item whose listing, sale or supply is illegal, or requires a licence, permit, classification or authorisation you do not hold, under applicable laws; or
  • (i) an Item that has been recalled, or that does not comply with an applicable product safety standard.

3. Orders and fulfilment

3.1 Marketplace. We provide the Marketplace to allow you to list and promote your Items. You are responsible for your listing and its accuracy, and for fulfilling orders for your Items.

3.2 Order confirmation. When a buyer places an order for your Item(s) in the Marketplace, you must confirm each order (by preparing it for collection, dispatching it for delivery or recording in the Marketplace that you are preparing the order) within [2] business days (in Victoria, Australia) via the Marketplace, or decline the order if the Item(s) are unavailable, you are otherwise unable to fulfil the order, there was an obvious typographical error in the listed price for any Item in the order, or we notify you that payment was not successfully processed. (For all declined orders where the Buyer has made payment, we will refund the Buyer on your behalf and may charge you a refund administration fee as set out in in our Shipping, Returns & Refunds Information.) Once you confirm the order for any Item(s), you agree to supply the Item(s) to the Buyer at the price(s) listed by the Seller in the Marketplace, on and subject to the Conditions of Sale which apply between you and the Buyer (Game Locker is not a party). You must not cancel or attempt to cancel an order because you believe the market value of an Item has changed after order confirmation.

3.3 Cancellation by Game Locker. We may cancel an order for any Item(s) if we reasonably suspect fraud, misuse of the Marketplace or breach of the Game Locker Marketplace Terms.

3.4 Fulfilment method. We determine which fulfilment methods (i.e. delivery or click-and-collect) are available to you, and may add or remove available methods over time. If we have not made additional methods available to you, then you must fulfil orders by delivery.

3.5 Seller fulfilment obligations. You must fulfil orders promptly, using the delivery or click-and-collect method the Buyer selected at checkout. You must keep order status information accurate and up to date. You may only fulfil orders within the locations we support from time to time as set out in our Shipping, Returns & Refunds Information.

3.6 Shipping charges. You may set your own shipping and handling charges.

3.7 Delivery orders. For delivery orders, you must package Items appropriately to protect them in transit, use tracked shipping where we require it (including for all delivery orders if you are an individual Seller), include a packing slip and, where required, a tax invoice. You remain responsible for the Item, and retain all risk in the Item, until it is delivered to the Buyer.

3.8 Click-and-collect orders. For click-and-collect orders, you must prepare the Item(s) within the time frame set out in our Shipping, Returns & Refunds Information (or any other time frame we notify you of in advance). You must notify the Buyer via the Marketplace as soon as practicable when the Item(s) are ready for collection and verify collection via the Marketplace. You must keep the Items available for collection for the collection period set out in our Shipping, Returns & Refunds Information or any other collection period we notify you of in advance. You must mark the order as collected within the Marketplace when, and only when, the Buyer has actually collected it.

4. Selling fees and payments

4.1 Game Locker as collection agent. You appoint and authorise Game Locker as your limited payment collection agent, to collect and hold payments from Buyers on your behalf via our third-party payment processors, and to remit you the proceeds of sale of your Items. You must give us valid, current payment and bank details, and any other information we or our payment provider reasonably need to verify you and prevent fraud.

4.2 Payments handling. We will collect payments from Buyers and remit your available balance approximately every 14 days, less our disclosed commissions, fees, refunds, chargebacks, reserves and any other amounts you owe us under the Game Locker Marketplace Terms. Proceeds from an order in the Marketplace become available only once it is confirmed as having been fulfilled (by tracking or collection confirmation).

4.3 Commissions. We take a commission on each sale, which is calculated a percentage of the sale price of each Item (excluding shipping). Current rates for our commission are on our Fees page (we will notify of material changes to that page in accordance with the Game Locker Marketplace Terms).

4.4 Payment processors. Marketplace purchases are processed by our third-party payment providers, in accordance with their processing terms. We are not responsible for the acts or omissions of our payment providers (unless they acted at our instruction). Our payment provider may apply reserves or holds under its own risk policies, which can delay your remittance. You are responsible for any payment processing fees imposed via our payment processors.

4.5 Refunds and fees. Where we provide a refund to a Buyer, we will also credit back the related commission we retained, less any refund administration fee specified in the Shipping, Returns & Refunds Information, against your next remittance.

4.6 Tax. You are responsible for any GST or other tax payable on your Item sales.

5. Fraud and chargebacks

You are responsible for fraudulent transactions, chargebacks and payment disputes connected with your Items (unless it’s caused by our error). We may deduct or recover the relevant amount from your payment remittances or otherwise from you.

6. Returns, refunds and delivery errors

6.1 Seller policy. You must comply with the Seller Returns Policy and our Shipping, Returns & Refunds Information. Even if you rely on a Game Locker-supplied template, you are solely responsible for ensuring you have an adequate, lawful Seller Returns Policy in place and for completing all required fields and making any adjustments required to ensure you comply with applicable laws and can honour its terms.

6.2 Returns and refunds. You must process cancellations, returns and refunds in accordance with the applicable Seller Returns Policy, the Conditions of Sale, and applicable law (including the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and State-based equivalent legislation). Refunds are based on the original purchase price, regardless of any later change in the market value of an Item.

6.3 Escalation to Game Locker. Generally, it is your responsibility to resolve order issues directly with Buyers. If you are unable to do so, you may contact Game Locker Customer Service for assistance but Game Locker does not guarantee it will resolve your issue or provide any particular outcome. If we are contacted by a Buyer and reasonably determine a refund or other remedy is owed (under applicable laws, the Conditions of Sale, the Seller Returns Policy or Game Locker Marketplace Terms), we may require you to provide it, or provide it ourselves and recover the cost, including any related fees, directly from you or from your remittances.

6.4 Cooperation. You must fully cooperate with Game Locker (including by promptly providing all reasonably requested information and evidence) in relation to any Buyer disputes, refund requests, chargebacks, fraud investigations, Item authenticity concerns or similar enquiries.

6.5 Seller responsibility. You are responsible for delivery errors, non-delivery and other fulfilment errors, and must reimburse us for any resulting refunds or costs (and pay any applicable refund processing or other fees disclosed in our Shipping, Returns & Refunds Information), unless we caused the error.

7. Content and intellectual property

7.1 Licence. You grant us a non-exclusive, royalty-free licence to use all content, images and descriptions you upload in your listings to operate, promote and display the Marketplace.

7.2 Listing accuracy. You are solely responsible for, and must ensure the accuracy and completeness of, any information you display or upload on the Marketplace about your product (including its description and information about its condition, printing, language and other material characteristics), pricing, availability and shipping. You must ensure you do not mislead Buyers, and you must immediately update any information that becomes or is discovered to be incomplete, inaccurate or potentially misleading. You may have responsibilities and liabilities under applicable law, the Conditions of Sale, your Seller Returns Policy and these Game Locker Marketplace Terms if you fail to do so.

8. Suspension, withholding and termination

8.1 Account closure. You may close your Seller account at any time, but must first fulfil or resolve any open orders and pay any outstanding fees or other amounts you owe us.

8.2 Withholding amounts. In addition to our other rights under the Game Locker Marketplace Terms, we may withhold, delay or offset amounts otherwise payable to you where reasonably necessary to cover potential refunds, chargebacks, disputes or a breach of these Seller Terms, including for up to 30 days after your selling privileges end. We will only do this where permitted by our third-party payment processors and applicable laws, and we will give you notice of such action and an opportunity to respond unless we reasonably believe urgent action is needed to prevent fraud or other harm.

8.3 Suspension and termination. If you materially or repeatedly breach the Game Locker Marketplace Terms (including the Acceptable Use Policy and Seller Code of Conduct), Conditions of Sale with any Buyer or Seller Returns Policy, we may suspend or terminate your account or selling privileges, or cancel a listing, acting reasonably, to protect the Marketplace and Buyers. Except where urgent action is reasonably necessary to prevent suspected fraud or harm, Game Locker will notify you about the proposed action, provide a reason and give you a reasonable opportunity to respond before taking it.
